Chronic Conditions

If you hurt your back at work, it may never be the same again. After the acute phase involving the immediate pain and injury, you will likely have ongoing issues. Even the most advanced treatments such as spinal fusion or spinal surgery are not always effective. In some cases, the surgical scarring causes problems of its own.

At the North Carolina law firm of Parker & Frey PLLC, we understand the difficulties surrounding chronic conditions. Our Fayetteville and Dunn workers’ compensation attorneys include a board-certified specialist. Together, our lawyers and staff are here to help you seek the care and money you need.

In addition to ongoing back, neck and spine issues, we handle cases involving all other types of chronic medical conditions. These include:

  • Chronic pain such as reflex sympathetic dystrophy (RSD)
  • Chronic obstructive pulmonary disease (COPD) such as chronic bronchitis or emphysema
  • Chronic issues related to knee injuries or injuries to other weight-bearing joints

Time Limits For Receiving Workers’ Comp Benefits

Depending on your particular situation, you may be eligible for lifetime workers’ compensation benefits for a chronic condition.

The North Carolina statute in place today states that if you have received benefits for 500 weeks (which is just short of 10 years) and you are now receiving Social Security retirement benefits, the amount of your worker’s comp benefits should decrease. However, there are always exceptions. If you became a quadriplegic at age 20, for instance, the 500 weeks would run out long before you reached retirement age, and the law has to account for this.

The laws are constantly changing and being reinterpreted through litigation, so it is wise to speak with an attorney who keeps up to date on these issues.
