North Carolina head-on collision kills 2

On Behalf of | Oct 21, 2014 | Wrongful Death |

Two men were killed in a head-on collision on I-26 in Hendersonville on Oct. 13 that caused the closure of the highway for nearly two hours. The accident happened around 9:30 p.m. when one of the drivers allegedly entered the highway via an off-ramp and drove the wrong way down the road.

According to the North Carolina Highway Patrol, a 91-year-old man was driving his pickup truck west, in the wrong direction, when he collided head-on with a vehicle driven by a 36-year-old man who was driving east. Both men were killed as a result of the impact. As it is standard procedure in fatal accidents, police collected blood for toxicology screening. However, they did not suspect alcohol to be a factor in the accident.

Police do not know why the elderly man drove the wrong way on the road. However, the police investigation might reveal all of the factors involved. In similar accidents, these have included distracted driving as well as road and weather conditions. If the police investigation reveals that the accident was the result of the man’s negligence, the information might be used in a wrongful death claim.

In cases where both a victim and the liable driver have been killed, the family of the victim might choose to consult with a personal injury lawyer who can help them file a claim for damages against the at-fault driver’s estate and insurance company, using evidence from the police investigation to show why the liable driver was responsible for the victim’s death. In North Carolina, the family of the victim might receive a monetary award for economic and non-economic damages, including the funeral and burial costs incurred by the family as well as remuneration for loss of companionship, support and services.
