Winston-Salem garbage truck worker dies from his injuries

On Nov. 26, a sanitation worker in Winston-Salem succumbed to injuries he suffered while on the job. According to reports, the 59-year-old man was struck by a SUV on Nov. 19 while he was working.

Investigating authorities indicated that the accident occurred when a Winston-Salem woman failed to see the man while driving on Barwick Road around 10:30 a.m. on the accident date. She apparently struck him with her SUV, seriously injuring him as a result.

Since the man has now passed away from his injuries, the N.C. Division of Occupational Safety and Health has reclassified the accident as a work-related death. The man had been employed by the city for 21 years when the accident occurred. The driver has not been charged in relation to the crash, and the city has indicated it is cooperating with the investigation into the accident and resulting death.

When a person is injured or killed in a workplace accident, compensation may be available for the resulting losses by filing a workers' compensation claim. When the worker dies as a result of his or her injuries, families may be able to recover money to pay for the cost of reasonable funeral and burial expenses, medical care received prior to the death and monthly payments for a portion of the worker's expected income. Injured workers may be able to recover medical expenses, disability payments and the costs for rehabilitation and needed prosthetic devices. At times, an employer will deny or dispute a workers' compensation claim. In the event that occurs, people may then go to hearings on the validity of their claims. It is important that people are prepared with medical documentation and other needed additional evidence regarding their work-related accident. A workers' compensation attorney may be able to help his or her clients recover the compensation they deserve.
